Can Payday Lenders Sue, Arrest, Or Put You In Jail For A Payday Loan?

Many payday loan consumers live in fear everyday because of unpaid payday loans.  The reason why is payday lenders sometimes threaten customers to pay back their payday loan debt within a short deadline or they could face serious consequences if they do not come up with the money on time.  

We have heard several threats and here are some of the most commonly used ones:

  1. We will sue you for check fraud.
  2. We will have someone arrest you.
  3. We will make sure you go to jail.

Are these true?  Can a payday lender really sue, arrest, or put you in jail for a payday loan?  The answer is no.  Defaulting on a payday loan is not a crime and cannot result in criminal charges.  This means that you cannot be prosecuted, arrested, or put in jail check fraud, breach of contract, or anything else that your payday lender might threaten you with.

Making false threats to collect on a debt is illegal in every state.  If your payday lender has threatened you with the statements above, or something similar, it is likely that your payday lender is conducting business illegally and is unlicensed.  This is usually the case if you received your payday loan from a company online.  90% of internet payday lenders are unlicensed, which means that they do not have the legal ability to take civil action against you.  For this reason, they threaten customers into paying them because they know that if they are not successful on collecting the debt themselves, then there is no other way for them to get their money back.  They also cannot take you to court if  you live in a state where payday lending is prohibited.  The states in which payday lending is not allowed are:

  • Connecticut
  • Georgia
  • Maine
  • Maryland
  • Massachusetts
  • New Jersey
  • New York
  • North Carolina
  • Pennsylvania
  • Vermont
  • Washington DC
  • West Virginia

Storefront payday lenders are a different case.  Storefront payday lenders are legal and licensed, which means that they can file a civil lawsuit against you.  The purpose of a civil lawsuit is to simply obtain a judgment for a wage garnishment so that they can be repaid.

To avoid civil action, you need to keep communication lines open between you and your licensed payday lender.  Taking you to small claims court for a payday loan is the last thing that your payday lenders want to do.  Suing you will take a lot of paperwork, money, and time out of your payday lender.  The only reason your payday lender will resort to civil action is if they are hopeless about getting their money back.  The best thing for you to do is to talk to them about your situation and try to work out an arrangement that you can both agree on so that you can both avoid the legal battle.

In some cases, your storefront payday lender may not cooperate with you for a payment arrangement.  If this is the case, try to contact their corporate office instead.  They are usually more lenient to work with and have power over the specific store that you borrowed the payday loan from.  If the corporate office accepts the payment arrangement you are proposing, the store cannot disapprove it.

To avoid encountering these problems in the future, keep in mind that payday loans are short-term loans that should be avoided at all costs.  Do not take out a payday loan unless you are 100% sure that you will be able to pay the full amount back in time.  Never take out more than one payday loan at a time because doing so will set you up for a trap that will be very difficult to get out of.

  2. I have a gentleman that is calling me, (cant understand him). He states that I own money as they were unable to collect from the bank. They want their money back on a green dot card. I told him that I need proof of this in way of a email that I would pay it back. However he refuses to do this, he then told me he would see me in court as I was trying to get out of this. I then tried calling him back at the number I had but it now was a non working number. would should I do

    • This happened to me on several different occasions. I went to my local police department and they did a background search on me and everything was clear and the police officer advised that this same situation was happening to many other people and they have gotten numerous complaints. He advised me to change my number or add a call block feature to my phone. That surely did the trick. The scam on sending the money via green dot is there is no way to trace it to them so they get rich on your money that you never owed in the first place!

  3. I did a payday loan online I pay them back two payments they stop taking the payment another time you taking off soon

I have a company calling stating they are litigators for a pay day loan from 2005 than they say 2008 that was done online and that they are going to servie papers to me for a civil lawsuit her in New jersey by coming to my place of employment. I am no longer at the same company i was at in 2008 and everytime I ask them to submitt something to me via email they refuse.

    • You should only pay a company if they can provide loan documents that you owe this money. If they cannot provide this information, that means this is a scam. The best thing for you to do is ignore their phone calls and I assure you that they will leave you alone after a day or two.

  6. after eights years can a payday or a collention agency take me to court to pay it back i did this pay day online eights years in 2005 i live in pennslyvinia

    • It depends where you got the loan from. If you got your loan from a storefront payday lender, it is possible that they can take you to a small claims court for the unpaid loan. However, if you received your loan from an unlicensed online lender, it would not be possible for them to take you to court.

  7. hello i am working with payday loan debt consolidation. i took out 6 online loans made some payments but had to close mmy bankaccount because i did not have the money to pay all the interest they charged me. i live in ny state all lenders were online so that means i cannot be charged with fraud or arrested. correct?

    • Hello Lauren,

      Since payday lending is prohibited in the state of New York, your payday lenders do not have the ability to pursue any legal action against you. They may not garnish your wages either to collect on your debt.

      Also, in the United States, you can never be charged a criminal action or arrested for a debt. Usually, this is a scare tactic that collectors use to threaten you into paying them. It is illegal for collectors to make false claims such as these and you can file a complaint against your collectors with the Better Business Bureau or Federal Trade Commission for threatening you with fake legal action.

  8. I know the feeling, I owe some online pay day lenders, and the harrass me alot,calling my job, I am the manager, so I tend to reject their calls.Sometimes things happen, and you just don’t have the money.
